These Terms and Conditions ("Terms") constitute a legally binding agreement between you and Bath Remodel Pro LLC ("Company," "we," "us," or "our") governing your access to and use of the Bath Remodel Pro software platform, web application, mobile applications, APIs, and associated services (collectively, the "Platform" or "Service", accessible at bathremodelpro.app).
Bath Remodel Pro is a specialized enterprise and field operations platform designed for bathroom remodeling contractors, specialists, and authorized service professionals to manage sales appointments, interactive estimate presentations, contract generation, electronic signatures, payments, project fulfillment, and customer communications.
Subject to these Terms, Bath Remodel Pro LLC grants authorized users a limited, non-exclusive, non-transferable, revocable license to access and use the Platform strictly for internal business operations and authorized customer engagements.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use or security breach. Bath Remodel Pro LLC reserves the right to suspend or terminate accounts that violate system policies or compromise platform security.
Customers and users who opt in to receive SMS text communications through the Bath Remodel Pro Platform agree to the following terms:
The Platform provides capabilities for presenting estimates, executing contracts, and processing change orders using digital signatures. By utilizing the Platform's electronic signature features, you acknowledge and agree that your electronic signature constitutes a legally binding agreement in compliance with the Electronic Signatures in Global and National Commerce Act (ESIGN) and the Uniform Electronic Transactions Act (UETA).
The Platform, including but not limited to its software architecture, source code, visual design, custom UI components, algorithms, databases, logos, trade dress, and documentation, is the proprietary intellectual property of Bath Remodel Pro LLC and is protected by United States and international copyright, trademark, trade secret, and other intellectual property laws. You may not reverse engineer, decompile, copy, modify, distribute, or create derivative works from the Platform without prior written authorization.
Your use of the Platform is also governed by our Privacy Policy, which explains how we collect, store, and process your data.
The Platform is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied. To the maximum extent permitted by law, Bath Remodel Pro LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising out of or related to your use of or inability to use the Platform.
These Terms shall be governed by and construed in accordance with the laws of the State of the Company's formation, without regard to its conflict of law provisions.
